Owner terms


 

1. Website Access

By accessing the website at https://www.oluxuryvillas.com, you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Rates and Commissions.

All rental rates are gross including all taxes & fees. The Agency earns a commission equal to 20% of the booking once is confirmed and non-refundable to the guest.

3. Payments.

All prepayment deposits of the rental (less Agency commission) will be paid to the owner due within 7 days of booking. For all balance payments (less Agency commission) we're responsible to follow the most current payment policy apply to the property. Reservations made within a nonrefundable period of the rental (less Agency commission) are due within 7 days of booking.

4. Cancellations.

The RENTAL DEPOSIT of 50% is nonrefundable until 60 days prior to the arrival date for bookings. Within 60 days prior to arrival, 100% of stay and fees are not refundable to the guest. Your cancelation policy applies online to the listing page on our website.

5. Booking Agreement and Rates.

For each reservation, Agency will enter into the most current booking agreement with the Owner. The agreed-upon rental rates are fully-inclusive and comprise all operating costs other than any value-added, sales accommodation tax.

6. Marketing.

The owner agrees that the Agency may prepare marketing materials and advertise the Residence on its website and elsewhere at the Agency’s discretion. Similarly, the Agency may place and maintain marketing and promotional materials relating to the products or services of the Agency or business partners.

7. Security Deposit.

The Agency is to collect and hold a security deposit, as security against damages to the Property. If there are no claims for damages by the Owner within 5 working days of departure, the security deposit may be released back to the guest.

8. Condition of the Property. 

Owner acknowledges and agrees throughout the Term it shall maintain the Residence in accordance with the Operating Standard established from time to time by the Agency and agrees to honor all Reservations established through the Rental Program. The owner will be responsible for any damages resulting from the Owner’s failure or refusal to honor such reservations.

9. Confidential Information.

Each party will keep secret all information made available by the other party, including the contents of this Agreement, the business practices of either party, and the details of each reservation.

10. Construction at Residence.

The owner agrees to notify the Agency of any proposed or ongoing construction work at the Residence.

11. Force Majeure.

If a circumstance outside the control of a Party prevents a client, acting reasonably, from having the normal use of the property or prevents either party from performing its obligations under this Agreement, all payments for any unused portion of the rental will be refunded to The Agency.

12. General Terms.

This Agreement has an initial one-year term starting on the date of this Agreement and will be automatically renewed for successive one-year terms. Either party may terminate this Agreement at any time for any reason upon 30 days prior written notice to the other Party.

13. Quality Assurance

Our clients are given the confidence when booking with O LUXURY VILLAS & OLV Travel Agency FZCO and its partners that the properties given are represented accurately and managed professionally. 

By listing with our sites you will also be listed on our national and international partnership sites and agree to be featured here, with photos and information found on oluxuryvillas.com and its sister sites. If you fail to meet the requirements:

 

  • The property is Accurately Depicted.
  • The properties are in perfect working condition.
  • There is a person on call for emergencies.
  • Rates are not fluctuating so much that it’s unmanageable.
  • Rates provided are commissionable by 20%.
  • The property Owner or Manager is providing a copy of the Business License.
  • All Sales and Local Resort Taxes are being paid, including taxes on the rentals we may have been receiving gross rates on.  This means you are responsible for collecting from O LUXURY VILLAS & OLV Travel Agency FZCO all taxes on amounts being published and paying them to the responsible reporting agency.
  • All contracts will be made under the client’s name, with our company email and address as a contract.
  • No Client of O LUXURY VILLAS & OLV Travel Agency FZCO will be solicited for future business by the owner or manager.
  • Access to email for availability or calendars online is accurate and available for quick reference.

At this time we would like to accommodate agencies looking for longer-term committed relationships with the same or like goals.
